Key Points
- Regulatory action is accelerating: The SEC and CFTC have moved forward with initiatives addressing digital assets after Congress failed to advance the CLARITY Act.
- Legislation remains unresolved: House Financial Services Committee Chairman French Hill argues that agency actions cannot substitute for a permanent statutory framework governing digital assets.
- Jurisdiction remains central: The proposed CLARITY Act is intended to establish clearer regulatory responsibilities between the SEC and CFTC, while the Senate's September vote left the broader framework unresolved.
Regulators Move Forward as Congress Stalls
The U.S. cryptocurrency market is receiving a growing number of regulatory initiatives, but House Financial Services Committee Chairman French Hill argues that agency action alone cannot provide the long-term certainty the industry needs. His comments come after the Senate failed to advance the CLARITY Act in September, leaving regulators to use existing authorities while lawmakers remain divided over comprehensive market-structure legislation.
Hill has credited SEC Chairman Paul Atkins and CFTC Chairman Mike Selig with using their regulatory powers to establish greater definition around digital assets and digital commodities. However, he maintains that permanent changes to federal law are still necessary to establish a durable framework.
Why the CLARITY Act Matters to the Market
The proposed legislation is designed to establish definitions for different types of digital assets while creating clearer boundaries between the SEC and CFTC. The House Financial Services Committee’s description of the bill includes provisions covering digital commodities, registration of digital commodity exchanges, brokers and dealers, and joint SEC-CFTC rulemaking.
Hill and other House leaders have previously argued that legislation is necessary because regulatory jurisdiction over digital assets cannot be permanently settled through agency guidance alone. After the Senate’s September vote failed to advance the measure, Hill and House Agriculture Committee Chairman Glenn Thompson said Congress still needed to establish clear statutory rules for the digital-asset ecosystem.
SEC and CFTC Expand Their Own Initiatives
The regulatory agencies have nevertheless continued moving forward. The CFTC recently proposed a federal oversight framework for certain cryptocurrency exchanges offering leveraged or margined trading, including a proposed category of regulated crypto-asset markets. The initiative followed Congress’s failure to enact comprehensive market-structure legislation.
The SEC has also pursued measures affecting digital-asset markets, while the agencies have increasingly used existing authorities to address areas that would have been covered more comprehensively by congressional legislation. These actions can provide interim guidance, but their scope remains tied to the powers already granted to the regulators.
The Senate Setback Leaves a Legislative Gap
The CLARITY Act failed to advance in the Senate on September 15 after a 49-50 procedural vote, falling short of the threshold required to move forward. Reuters reported that the legislation had been intended to establish a broader regulatory framework for digital assets and clarify the roles of the two principal market regulators.
The result does not eliminate the possibility of future legislation, but it leaves the industry operating within a combination of existing law, agency rulemaking and regulatory guidance while congressional negotiations continue.
What Investors Should Watch Next
The central question for digital-asset investors is whether regulatory agencies can provide sufficient certainty while Congress remains unable to enact a comprehensive market-structure framework. Further SEC and CFTC actions could gradually define how exchanges, intermediaries and digital assets operate in the U.S., but legislation would provide a broader statutory foundation. Investors should therefore monitor additional agency rules, court challenges, congressional negotiations and any renewed effort to advance market-structure legislation, as each could materially affect the regulatory environment for crypto businesses and assets.
