Tesla is facing additional regulatory scrutiny over its Cybercab robotaxi after the U.S. National Highway Traffic Safety Administration ordered the company to provide detailed answers about how the vehicle was certified. The inquiry comes as Tesla begins deploying a small number of driverless Cybercabs in Austin, Texas, placing greater attention on whether existing federal vehicle standards can accommodate autonomous designs.

NHTSA Questions the Basis of Tesla’s Certification

NHTSA said Tesla must respond by September 30 to a series of questions examining whether the company properly self-certified the Cybercab as compliant with applicable Federal Motor Vehicle Safety Standards. The agency specifically wants Tesla to clarify whether temporarily installed human driver controls or other equipment formed part of the technical basis used to establish compliance.

The issue is significant because US vehicle regulation operates under a self-certification framework. Manufacturers are responsible for certifying that their vehicles comply with applicable federal safety requirements, while NHTSA retains authority to investigate compliance and safety concerns. The agency’s current audit therefore focuses not simply on the Cybercab’s autonomous technology, but on the regulatory process Tesla used to establish that the vehicle meets existing requirements.

Autonomous Design Meets Traditional Safety Standards

The Cybercab presents a regulatory challenge because it is designed around driverless operation rather than conventional human-controlled driving. NHTSA’s September 4 investigation said the agency was examining the technical data and processes Tesla relied upon to certify a vehicle lacking traditional human controls, including whether certain existing safety requirements were considered inapplicable to an automated vehicle.

That distinction matters because current federal standards were largely developed around vehicles operated by human drivers. Requirements involving components such as steering controls, brake pedals and rear-view equipment can become more complicated when a vehicle is deliberately engineered without those conventional interfaces. For Tesla, the inquiry comes at an important stage in its autonomous-vehicle strategy. The company has begun limited Cybercab deployment in Austin, Texas, making the regulatory treatment of the vehicle increasingly relevant to any future expansion of robotaxi operations. A requirement to redesign equipment, modify certification procedures or seek additional regulatory accommodations could affect the pace at which the vehicle can be deployed more broadly.
