The Federal Trade Commission and attorneys general from 22 U.S. states have filed a lawsuit against Amazon, accusing the e-commerce giant of secretly inflating prices in its online advertising auctions. The case places renewed regulatory pressure on Amazon as its advertising business has become an increasingly important contributor to the company’s overall financial performance and the broader digital advertising market.

FTC Alleges Amazon Manipulated Its Advertising Auctions

The lawsuit, filed in the U.S. District Court for the Western District of Washington, alleges that Amazon overcharged approximately 1.2 million advertising customers through changes to the auction system used to determine prices for Sponsored Products, Sponsored Brands and Sponsored Display advertisements.

According to the complaint, Amazon had represented that its advertising auctions operated under a second-price model, in which the winning advertiser would generally pay only slightly more than the next-highest competing bid. The FTC alleges that, beginning in 2019, Amazon introduced an undisclosed surcharge that effectively increased the amount advertisers paid beyond what genuine competition in the auction would have produced.

The FTC claims the practice generated more than $20 billion from advertisers and affected more than one million brands and sellers, including hundreds of thousands of small and medium-sized businesses. The complaint further alleges that Amazon increased the surcharges during high-volume shopping periods such as Prime Day and Black Friday.

Amazon Advertising Faces a New Regulatory Challenge

The allegations are significant because advertising has become a major growth engine for Amazon. The company generated more than $68 billion in annual advertising revenue, making it one of the largest digital advertising platforms globally and placing it behind the leading advertising businesses operated by companies such as Alphabet and Meta.
