3M Reaches Broad Resolution of PFAS Personal Injury Claims

Industrial conglomerate 3M announced on Tuesday that it had entered into a broad agreement to resolve personal injury claims associated with PFAS, commonly referred to as “forever chemicals.”

The settlement carries a nominal pre-tax commitment of $7.35 billion, payable over nine years, with a present value of approximately $5.8 billion. The company expects to recognize the corresponding pre-tax charge in the fourth quarter of 2026.

According to 3M, the agreement addresses approximately 99% of current personal injury claims both inside and outside the Aqueous Film-Forming Foam Multi-District Litigation, known as the AFFF MDL.

Approximately 115,000 to 120,000 plaintiffs are eligible to participate, including all personal injury claims that have been the focus of the litigation.

Nine-Year Payment Structure

The settlement establishes a payment schedule extending over nine years, with payments distributed across the agreement period.

3M will make an initial payment of $50 million in 2026, followed by no scheduled payments in 2027. Approximately 20% of the total payments are expected to fall within the final two years of the settlement period.

The extended structure spreads the company’s financial commitment over time rather than requiring an immediate payment of the full nominal amount.

The distinction between the $7.35 billion nominal commitment and its $5.8 billion present value reflects the timing of the future payments.

Settlement Reduces Litigation Uncertainty

3M Chief Executive William Brown described the agreement as a significant milestone for the company, stating that it substantially reduces litigation uncertainty.

The resolution covers a substantial portion of the company’s current PFAS-related personal injury claims and provides a framework for addressing the eligible cases.

However, 3M emphasized that the agreement does not constitute an admission of liability. The company also stated that it would be prepared to continue defending itself if the agreed settlement terms are not fulfilled.

PFAS Manufacturing Phaseout

The settlement follows 3M’s previously announced plan to discontinue manufacturing all PFAS globally by the end of 2025.

The company said it successfully achieved that objective.

The manufacturing phaseout and the personal injury settlement represent separate elements of 3M’s response to PFAS-related issues, with the latest agreement addressing the financial and legal implications of outstanding claims.

Financial Outlook Remains Unchanged

Despite the expected $5.8 billion pre-tax charge in the fourth quarter, 3M said the settlement would not change its previously issued financial forecast for 2026.

The company did not indicate any revision to its full-year outlook alongside the announcement.

The settlement therefore introduces a substantial accounting charge while leaving the company’s stated annual forecast unchanged.

What Investors Should Watch Next

Investors will be monitoring the implementation of the nine-year payment schedule, the participation of eligible plaintiffs and the company’s handling of any claims that fall outside the resolution.

The fourth-quarter recognition of the $5.8 billion pre-tax charge will also be important in assessing the settlement’s reported financial impact. The agreement’s execution and its ability to address approximately 99% of current personal injury claims will remain central to evaluating the reduction in litigation uncertainty.
