CK Hutchison has escalated its legal battle with Panama by seeking more than $1.5 billion in an international treaty arbitration, intensifying a dispute over two strategically important ports serving the Panama Canal. The case comes against a backdrop of heightened U.S.-China geopolitical tensions and growing scrutiny of foreign ownership of critical infrastructure.

CK Hutchison Escalates Its Legal Challenge Against Panama

The Hong Kong-based conglomerate, controlled by billionaire Li Ka-shing, is accusing Panama of violating an investment protection treaty through actions that resulted in the dismantling of its concession agreement and the takeover of its port terminals at Balboa and Cristóbal. The two facilities sit at opposite ends of the Panama Canal and had been operated by CK Hutchison’s subsidiary, Panama Ports Company (PPC), for nearly three decades.

The latest treaty claim is separate from an earlier arbitration initiated by PPC under the rules of the International Chamber of Commerce. PPC has expanded that separate case to seek more than $2 billion in damages following Panama’s actions against its concessions. CK Hutchison had already intensified its legal response in March, saying Panama had occupied the ports and taken control of PPC property and personnel.

Panama Canal Ports Become a Geopolitical Flashpoint

The dispute extends beyond the commercial value of the terminals. The ports became a focal point in broader tensions over Chinese-linked ownership and strategic control around the Panama Canal, particularly after U.S. President Donald Trump raised concerns about Chinese influence over infrastructure in the region. Panama subsequently moved to revoke CK Hutchison’s port concessions, while the company has disputed the legitimacy of those actions.

Panama’s Supreme Court ruled in January 2026 that the concession contracts were unconstitutional, citing provisions including exclusive privileges and tax exemptions. Panama has defended the subsequent takeover, while CK Hutchison has characterized the actions as unlawful and has pursued both domestic and international legal remedies.

Financial and Strategic Implications for CK Hutchison

The port dispute has already affected CK Hutchison’s operating performance. In the first half of 2026, the company said its ports division absorbed a HK$496 million impact from the disruption in Panama, while cargo throughput across the ports business declined 1%. Despite the disruption, ports EBITDA increased 4% to HK$9 billion, helped by performance elsewhere in the division. At the group level, underlying profit rose 6.7% to HK$12.6 billion in the first half.

The legal uncertainty also complicates CK Hutchison’s proposed $23 billion sale of most of its global port assets to a consortium involving BlackRock and Mediterranean Shipping Company, with China’s COSCO potentially involved. The company has previously said there had been no progress on the transaction, making the Panama dispute an important factor for the valuation and structure of the broader deal.

The treaty arbitration is likely to become a prolonged legal process, with the outcome potentially influencing compensation, the treatment of foreign investments and the future ownership of strategically important port infrastructure.
